Tariffs may vary depending on the media whishing to reproduce the photos. Each case is subject to individual evaluation.

 

Whose is the copyright of the author’s images?

Intellectual copyright law in Spain establishes that the rights of exploitation of a work of art are applicable during the life of its author and seventy years after his death, passing on thereafter to his/her heirs. Therefore, Xavier Miserachs daughters are in charge of the reproduction, distribution, public communication and potential transformations of their father’s photo archive. According to this, Miserachs’ heirs have the right to reproduce prints from the negatives of his photo archive in any form and as many times as they may consider appropriate. Thus, his heirs have the moral rights over his archive.

 

I’m interested in acquiring photo by Xavier Miserachs.

We propose you to visit Miserachs’ archive to come in contact with all his photos and to consider the different modalities they may be presented in: vintage paper prints, fibre paper prints etc.

 

What should I take under consideration while acquiring an original print?

Permission to use a print out doesn’t imply any cession of the print’s copyrights* (reproduction, distribution, public communication, transformation). The ownership of the stand used to exhibit the print out (or any other work of art), only allows the exhibitors to use it for its public exhibition (according to what’s established by the article 56 of the Copyright Law). Thus, those who acquire prints belonging to Xavier Miserachs’ archive aren’t allowed to reproduce them without a previous authorisation issued by the owners of the exploitation rights, his heirs.

*Therefore, every single print use is subject to an explicit permit and/or explicit right.
